Marketplace Terms
Last updated: October 2026
1. About these terms
These Marketplace Terms of Use ("Marketplace Terms") govern your use of the second-hand marketplace available through Airsoft.Bio ("the Bio", "we", "us" or "our").
Airsoft.Bio provides an online platform where users can list second-hand airsoft products and communicate with other users through messaging tools. Our role is to help buyers and sellers find each other and communicate.
Airsoft.Bio is not a party to transactions between buyers and sellers. Unless expressly stated otherwise, we do not sell, buy, own, inspect, store, package, deliver or process payments for listed products.
By accessing or using the Marketplace, you agree to these Marketplace Terms, together with our general Terms of Service and Privacy Policy. If you do not agree, you must not use the Marketplace.
These Marketplace Terms supplement, rather than replace, any applicable statutory rights or legal obligations.
2. Eligibility and account requirements
2.1. You must be at least 18 years old to access or use the Marketplace, whether as a buyer or a seller.
2.2. You must provide accurate information when registering for an account and keep your account details up to date.
2.3. You are responsible for maintaining the security of your account and for activity carried out through it.
2.4. You must not create an account using false information, impersonate another person or use another person's account without permission.
2.5. Airsoft.Bio does not routinely verify the identity, age, eligibility or legal status of every Marketplace user. The absence of verification does not remove your obligation to establish that you are legally permitted to participate in a particular transaction.
2.6. We may request additional information, restrict access or suspend an account where reasonably necessary to investigate suspected fraud, enforce these terms or comply with legal obligations.
3. The role of Airsoft.Bio
3.1. The Marketplace is a platform for connecting buyers and sellers. Users communicate directly and independently decide whether to enter into a transaction.
3.2. Airsoft.Bio does not act as an agent, broker, auctioneer, dealer, payment intermediary or guarantor for users' transactions, except where expressly agreed in writing.
3.3. We do not guarantee the accuracy, completeness, legality, quality, safety, authenticity, condition or availability of any listing or product.
3.4. We do not routinely inspect products, verify ownership, test equipment, authenticate brands, confirm seller eligibility or establish whether an item complies with the laws of a particular country.
3.5. We do not guarantee that a buyer or seller will complete a transaction, deliver a product, make payment or resolve a dispute.
3.6. Listings, messages, profiles and other user-generated content represent the views and information of the relevant users, not necessarily those of Airsoft.Bio.
3.7. We may provide reporting tools, moderate content and take action against accounts or listings. However, we do not undertake to investigate or resolve every disagreement or alleged breach between users.
4. Permitted products
4.1. The Marketplace is exclusively for second-hand airsoft products and related equipment.
Permitted categories may include:
- Airsoft guns and replicas.
- Airsoft accessories and attachments.
- Clothing and protective equipment intended for airsoft.
- Electronics, optics and aiming accessories intended for airsoft.
- Airsoft parts and upgrade components.
- BBs and other airsoft consumables.
4.2. Products must be accurately described and genuinely related to airsoft. We may remove listings that fall outside the Marketplace's intended purpose.
4.3. Products must be lawfully owned and available for sale by the person listing them. You must not list stolen goods, counterfeit products, unlawfully obtained items or products that you have no legal right to sell.
4.4. Airsoft.Bio may restrict additional products or categories where we consider this necessary for safety, legal compliance or the proper operation of the Marketplace.
5. Prohibited products and activities
You must not list, offer, buy, sell or arrange the transfer of any product or service that is unlawful, prohibited by these terms or otherwise unsuitable for the Marketplace.
Prohibited listings and activities include:
- Real firearms, live ammunition, explosives and prohibited weapons.
- Stolen goods, counterfeit goods and products that infringe another person's intellectual property rights.
- Products that the seller is not legally entitled to possess, advertise, transfer or sell.
- Items that are prohibited by applicable import, export, customs, transport or postal regulations.
- Products falsely described as genuine, functional, safe, compliant or in a particular condition.
- Listings intended to facilitate fraud, theft, unlawful transfers or other criminal activity.
- Non-airsoft products or services that do not fall within the permitted categories.
- Attempts to evade applicable laws, platform restrictions or these Marketplace Terms.
The fact that a product is described as an airsoft replica, has a brightly coloured exterior or is commonly used in airsoft does not automatically make its sale, possession, import or transfer lawful in every jurisdiction.
Airsoft.Bio may remove any listing that we reasonably believe breaches these rules or presents a legal, safety or platform-integrity risk.
6. Legal compliance and responsibility for transactions
6.1. Buyers and sellers are independently responsible for ensuring that their transactions comply with all applicable laws and regulations.
6.2. Before listing, purchasing, transferring, importing, exporting, shipping or collecting an item, you must establish whether the relevant activity is lawful in every applicable jurisdiction.
6.3. Depending on the product and circumstances, this may include laws relating to:
- Firearms, imitation firearms and airsoft replicas.
- Minimum ages and eligibility requirements.
- Realistic imitation firearms and any applicable defences or exemptions.
- Product ownership, possession, sale and transfer.
- Importation, exportation, customs and border controls.
- Postal, courier and dangerous-goods restrictions.
- Consumer protection, distance selling and refunds.
- Tax reporting and other obligations arising from selling goods.
6.4. Where a transaction involves the United Kingdom, users must comply with the relevant UK legislation and any applicable rules in the particular UK jurisdiction. Transactions involving other countries must also comply with the laws of those countries.
6.5. Buyers and sellers must make their own enquiries and must not rely on the existence of a listing, another user's assurances or the availability of Marketplace features as confirmation that a transaction is lawful.
6.6. Airsoft.Bio does not provide legal advice, certify the legality of products or guarantee that any particular buyer or seller qualifies for a legal exemption or defence.
6.7. We recommend that users consult Airsoft.Defence for guidance when checking airsoft-related legal compliance. This is a recommendation only. It is not a substitute for checking the applicable law, obtaining professional advice where necessary or independently verifying the requirements for a specific transaction.
6.8. You must not proceed with a transaction if you know, suspect or have reasonable grounds to believe that it would breach applicable law.
7. Seller obligations
By creating a listing, you agree that:
7.1. You have the legal right to list and sell the product and will comply with all applicable requirements governing its sale and transfer.
7.2. Your listing will accurately describe the product, including its make, model, condition, known faults, modifications, included accessories and any material limitations.
7.3. You will use genuine photographs of the actual product wherever practicable and will not use misleading images or descriptions.
7.4. You will disclose known damage, defects, missing components, safety concerns and other information that could reasonably affect a buyer's decision.
7.5. You will not misrepresent a product's performance, authenticity, age, service history, legal status or compatibility.
7.6. You will not list a product that you cannot lawfully sell, transfer or deliver to the intended buyer.
7.7. You will communicate honestly and in good faith, honour any agreement you enter into and update or remove a listing when the product is no longer available.
7.8. You will not request or encourage a buyer to misrepresent their age, identity, eligibility, intended use or other information relevant to the lawfulness of the transaction.
7.9. You will package and dispatch products safely and comply with applicable postal, courier, customs and transport requirements.
7.10. You will not use the Marketplace to conduct fraudulent activity, evade legal obligations or mislead buyers about the identity of the seller.
8. Buyer obligations
By contacting a seller or purchasing a product, you agree that:
8.1. You will make appropriate enquiries about the product's condition, suitability, compatibility and legal status before agreeing to buy.
8.2. You will independently establish that you are legally entitled to purchase, possess, import and receive the product.
8.3. You will review the seller's description, ask questions where necessary and agree the price, payment method, delivery arrangements and other transaction details directly with the seller.
8.4. You will not knowingly provide false information, evade legal requirements or ask a seller to participate in an unlawful transaction.
8.5. You will exercise reasonable caution when communicating with unfamiliar users and making payments.
8.6. You will comply with agreed payment and collection arrangements and communicate promptly if a problem arises.
8.7. You will not use the Marketplace to harass, threaten, defraud or otherwise exploit another user.
9. Prices, payments and transaction agreements
9.1. Listings on Airsoft.Bio are free. Airsoft.Bio does not charge a Marketplace listing fee or transaction commission under the current service model.
9.2. Buyers and sellers agree prices and payment arrangements directly between themselves.
9.3. Payments take place outside Airsoft.Bio. We do not collect or hold purchase funds, provide escrow, guarantee payment, issue refunds from transaction funds or provide a payment protection scheme.
9.4. Buyers and sellers are responsible for checking payment details, confirming the agreed amount and deciding which payment method is appropriate.
9.5. You should consider using a payment method that offers suitable protection for private second-hand transactions. Bank transfers, cash and other payment methods may offer limited or no recovery options in some circumstances.
9.6. You must not misrepresent a payment, send fraudulent payment confirmations or knowingly use stolen payment credentials.
9.7. Any sale agreement is between the buyer and seller. Airsoft.Bio is not responsible for collecting payment, recovering money, enforcing the agreement or compensating either party for a failed transaction, except to the extent that liability cannot lawfully be excluded.
10. Collection, delivery and shipping
10.1. Buyers and sellers may agree to collection in person or delivery by post or courier.
10.2. The buyer and seller are responsible for agreeing who will arrange and pay for delivery, the expected delivery timeframe, the delivery address, packaging requirements and any tracking or insurance arrangements.
10.3. Sellers must use a postal or courier service that accepts the particular product and comply with all relevant packaging, labelling, customs, import, export and transport requirements.
10.4. Sellers must not conceal, misdeclare or falsely describe a product to evade postal, courier, customs or legal restrictions.
10.5. Buyers and sellers are responsible for checking whether a product may lawfully be sent to, received in or transported through the relevant locations.
10.6. Airsoft.Bio does not arrange delivery, take custody of products, inspect packages, guarantee delivery times or determine responsibility for loss or damage during transit.
10.7. Any agreement concerning delivery, risk, insurance or proof of dispatch is between the buyer and seller, subject to applicable law.
10.8. Users arranging collection in person should take reasonable precautions to protect their personal safety and comply with all applicable laws governing the transport and handling of airsoft replicas.
11. Condition, returns, refunds and statutory rights
11.1. The condition of a second-hand product should be clearly described by the seller. Buyers should ask questions and request further information before committing to a purchase if they are uncertain.
11.2. Airsoft.Bio does not provide a warranty for products listed by users and does not operate a Marketplace returns or refunds programme.
11.3. Any voluntary returns policy, refund arrangement or warranty offered by a seller is a matter between the buyer and seller and must comply with applicable law.
11.4. Nothing in these Marketplace Terms removes or limits any statutory rights or remedies that a buyer or seller may have under applicable law.
11.5. A transaction between private individuals may be treated differently from a transaction involving a trader. Sellers who act as traders or businesses must comply with the legal obligations that apply to them, including any applicable consumer protection requirements.
11.6. A seller must not falsely claim to be a private individual to avoid legal obligations that apply to a business or trader.
11.7. Buyers should not assume that every second-hand purchase carries a right to return an item simply because they change their mind. Equally, sellers must not use these terms to avoid legal responsibilities for misrepresentation, fraud or other matters where liability cannot lawfully be excluded.
12. Scams, fraud and user safety
12.1. Users are responsible for exercising reasonable care when dealing with other users.
12.2. Before paying, buyers should consider checking the seller's profile, requesting additional photographs or information, confirming the product's availability and ensuring that the payment recipient matches the agreed transaction.
12.3. Sellers should check that payments have genuinely cleared before handing over or dispatching products. A screenshot or message claiming that payment has been made is not proof that funds have been received.
12.4. Users must not share passwords, authentication codes or unnecessary personal or financial information with other users.
12.5. Users must not use the Marketplace for phishing, impersonation, fraudulent payment requests, fake listings, chargeback abuse or other deceptive activity.
12.6. If you suspect a scam or unlawful listing, stop communicating or paying where appropriate, preserve relevant evidence and report the matter to Airsoft.Bio. Where appropriate, contact your bank, payment provider, postal service or the relevant authorities.
12.7. Airsoft.Bio may take reasonable steps to restrict suspicious accounts or listings, but we cannot guarantee the prevention or detection of every scam or fraudulent transaction.
13. Listings, messaging and user conduct
13.1. Users must not post content that is unlawful, fraudulent, misleading, threatening, abusive, discriminatory or otherwise prohibited by our platform rules.
13.2. You must not use Marketplace messaging to harass other users, send malicious links, distribute malware, impersonate another person or facilitate unlawful transactions.
13.3. You must not manipulate listings, create misleading duplicate listings, falsely claim to have sold a product or interfere with another user's legitimate use of the Marketplace.
13.4. You must not upload content that infringes another person's intellectual property, privacy or other legal rights.
13.5. You are responsible for the content you submit and for ensuring that you have the necessary rights to publish any photographs, descriptions or other materials.
13.6. Airsoft.Bio may remove, edit, restrict or disable access to listings, messages or other content where reasonably necessary to enforce these terms, protect users, maintain platform integrity or comply with law.
13.7. We do not guarantee that every listing or message will be reviewed before it becomes available to other users.
14. Reporting, moderation and disputes
14.1. Users may report suspected unlawful listings, scams, misleading descriptions, prohibited products or other breaches of these Marketplace Terms using the reporting tools made available by Airsoft.Bio.
14.2. Where appropriate, we may review reports, request information, remove content, restrict features, suspend accounts or take other reasonable moderation measures.
14.3. We may prioritise reports based on their apparent seriousness, urgency, available evidence and applicable legal obligations.
14.4. Airsoft.Bio does not provide a formal buyer protection scheme, binding arbitration service, transaction guarantee or general dispute resolution service.
14.5. Buyers and sellers are responsible for attempting to resolve disagreements directly and for pursuing any available legal remedies where necessary.
14.6. We may, at our discretion, facilitate communication or take platform-related action, but we are not required to mediate every dispute, determine who is telling the truth or compel a user to refund money or deliver a product.
14.7. We do not guarantee a particular outcome from a report or investigation.
14.8. Nothing in this section prevents a user from contacting a payment provider, seeking independent legal advice or reporting suspected criminal conduct to the relevant authorities.
15. Intellectual property and platform use
15.1. Airsoft.Bio and its associated branding, software, design and platform materials are protected by applicable intellectual property laws.
15.2. You must not copy, exploit, reverse engineer or misuse Airsoft.Bio's platform or intellectual property except where permitted by law or with our permission.
15.3. You retain ownership of content that you own and upload. By submitting content to the Marketplace, you grant Airsoft.Bio a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and distribute that content as reasonably necessary to operate, provide, promote and improve the platform and its features.
15.4. This licence lasts for as long as reasonably necessary for those purposes, subject to applicable law and our Privacy Policy. You should only upload content that you have permission to use.
15.5. We may remove content when a listing is deleted, an account is closed or removal is otherwise appropriate, subject to legal, security, evidential and operational requirements.
16. Privacy and personal information
16.1. Airsoft.Bio processes personal information in accordance with its Privacy Policy and applicable data protection law.
16.2. Information you choose to share with another user, including information shared through messaging, is shared at your own discretion. You should avoid disclosing unnecessary personal information.
16.3. Users must not collect, misuse, publish or distribute another user's personal information for unlawful purposes, harassment, intimidation or other unauthorised activity.
16.4. Airsoft.Bio may process or disclose information where reasonably necessary to operate the service, investigate suspected abuse, protect users, comply with legal obligations or respond to lawful requests from competent authorities.
16.5. Our Privacy Policy explains how we handle personal information, including applicable retention practices and user rights.
17. Suspension, removal and termination
17.1. We may remove listings, restrict Marketplace features or suspend or terminate accounts where we reasonably believe that a user has breached these terms, engaged in fraudulent or unlawful activity, endangered users or misused the platform.
17.2. We may also take action to comply with legal obligations, respond to credible reports or address security and operational risks.
17.3. Where appropriate and lawful, we may provide an explanation for our decision. We are not required to provide advance notice where immediate action is reasonably necessary to prevent harm, address abuse or comply with law.
17.4. Users may stop using the Marketplace at any time. Closing an account does not automatically cancel or resolve agreements already entered into with other users.
17.5. Suspension or termination does not remove any rights, liabilities or obligations arising before the relevant action.
18. Disclaimers and limitation of liability
18.1. To the extent permitted by law, Airsoft.Bio provides the Marketplace on an "as available" basis and does not guarantee uninterrupted availability, error-free operation or the accuracy or reliability of user-generated content.
18.2. Airsoft.Bio is a platform for connecting users. We are not the seller or buyer in a transaction and do not take responsibility for the condition, quality, safety, legality, ownership, authenticity, payment, delivery or receipt of products traded directly between users.
18.3. To the fullest extent permitted by applicable law, Airsoft.Bio excludes liability for losses arising directly from transactions between users, including losses resulting from a user's failure to pay, deliver, describe a product accurately or comply with applicable law.
18.4. To the fullest extent permitted by law, Airsoft.Bio is not responsible for indirect or consequential losses, loss of profit, loss of opportunity or loss of data arising from use of the Marketplace.
18.5. These exclusions do not apply to liability that cannot lawfully be excluded or limited. Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability where exclusion or limitation is prohibited by law.
18.6. Nothing in these terms affects any mandatory statutory rights that apply to you or prevents a competent authority or court from determining our legal responsibilities.
18.7. Where you use the Marketplace as a consumer, any liability limitation will apply only to the extent that it is fair and legally enforceable in the circumstances.
18.8. Users remain responsible for their own actions, listings, communications and transactions. However, these terms do not absolve Airsoft.Bio of any legal duties that apply to it independently of a user's conduct.
19. Changes to the Marketplace and these terms
19.1. We may change, suspend or discontinue Marketplace features, including messaging, listing tools and other functionality.
19.2. We may update these Marketplace Terms to reflect changes in law, platform functionality, security requirements or our operating practices.
19.3. We will take reasonable steps to communicate material changes where required by law. The latest version will be made available through Airsoft.Bio with its updated date.
19.4. Changes will apply from the effective date stated in the updated terms, subject to any notice or consent requirements imposed by applicable law.
19.5. If you do not agree to a change, you must stop using the Marketplace. Any rights or obligations that have already arisen remain subject to the applicable law and the terms governing the relevant transaction.
20. Governing law and jurisdiction
20.1. These Marketplace Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of England and Wales, except where applicable law requires otherwise.
20.2. Subject to mandatory consumer protection rules and any applicable jurisdictional requirements, the courts of England and Wales will have jurisdiction over disputes arising from these Marketplace Terms.
20.3. If you are a consumer resident in another jurisdiction, you may retain mandatory protections or rights to bring proceedings in your local courts where applicable law provides for them.
20.4. The governing law of these Marketplace Terms does not determine which laws apply to a particular sale, product transfer, import, export or delivery. Buyers and sellers must independently comply with all laws applicable to their transaction.
21. General provisions
21.1. If any provision of these Marketplace Terms is held to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
21.2. A failure or delay by Airsoft.Bio in enforcing a provision does not constitute a waiver of our right to enforce it later.
21.3. These Marketplace Terms, together with the applicable general Terms of Service and Privacy Policy, govern your use of the Marketplace. If there is a conflict between these Marketplace Terms and another document, the relevant terms should be interpreted consistently where possible, subject to applicable law.
21.4. You may not transfer your rights or obligations under these Marketplace Terms where doing so would breach them or applicable law.
21.5. Nothing in these Marketplace Terms creates a partnership, employment relationship, agency or joint venture between Airsoft.Bio and any user.
